The Board of Examiners of Nursing Home Administrators regulates and licenses nursing home administrators. The Board does not regulate assisted living administrators or home health care providers. The mission of the Board is to safeguard the health, safety, and welfare of the people of Colorado by developing and maintaining rules and policies to ensure that only qualified persons are licensed to practice as nursing home administrators and that violators of the laws and rules regulating nursing home administration are sanctioned as appropriate.
Board activities include licensing nursing home administrators, investigating complaints about the licensed and unlicensed practice of nursing home administration, disciplining violators of the law and/or the Board's Rules. Activities also include making, amending, and adopting reasonable rules and regulations governing the conduct of nursing home administrators. The Board is made up of five members: three nursing home administrators and two public members.

REQUESTING WRITTEN STAKEHOLDER COMMENTS
Implementation of Colorado Senate Bills 23-188 and 23-265What is this about?
The following Boards and Programs within the Division of Professions and Occupations are requesting written comments regarding the implementation of Colorado Senate Bills 23-188 (CONCERNING A PROHIBITION ON A REGULATOR IMPOSING DISCIPLINE AGAINST A PERSON BASED ON CERTAIN ACTIVITIES INVOLVING MARIJUANA) and 23-265 (CONCERNING A PROHIBITION ON A REGULATOR IMPOSING DISCIPLINE AGAINST A PERSON BASED ON CERTAIN ACTIVITIES INVOLVING MARIJUANA), and the proposed repeal of the Board and Program rules that are no longer necessary after the codification of these regulations into law.
Each of the listed Boards and Programs will hold a Permanent Rulemaking Hearing on the dates listed to determine whether to repeal the rules on a permanent basis to implement the law. Please submit written comments as soon as possible. The Boards and Programs will continue to accept written comments until the Permanent Rulemaking Hearings where stakeholders will be given a final opportunity to testify before the Board and/or the Director or Director's designee. Emergency and Permanent Rulemaking Hearing - September 14, 2022
The Colorado Board of Examiners of Nursing Home Administrators will hold an Emergency and Permanent Rulemaking Hearing to allow stakeholders a final opportunity to provide testimony before the Board considers adopting multiple proposed new and revised rules to implement Colorado Senate Bill 22-116 (Concerning the ability of an individual to obtain an occupational credential through the occupational credential portability program); Colorado House Bill 22-1284 (Concerning updates to state surprise billing laws to facilitate the implementation of surprise billing protections, and aligning state law with the federal "No Surprises Act"); Executive Order D 2022-032 (Directing State Agencies to Protect Access to Reproductive Health Care in Colorado); and Executive Order D 2022-034 (Protecting Colorado’s Workforce and Expanding Licensing Opportunities). The Board will consider all proposed rules on a permanent basis, and in addition, will consider emergency adoption of the new rules implementing the Executive Orders to comply with the Governor’s 90-day reporting requirements.

The Division of Professions and Occupations' held a Joint Stakeholder Meeting for all Healthcare Boards and Programs that allowed stakeholders an opportunity to provide feedback, and help develop new and/or revised rules to implement Colorado House Bill 22-1284 (Concerning updates to state surprise billing laws to facilitate the implementation of surprise billing protections, and, in connection therewith, aligning state law with the federal "No Surprises Act").
Permanent Rulemaking Hearing - November 10, 2021
The Colorado Board of Examiners of Nursing Home Administrators held a Permanent Rulemaking Hearing on November 10, 2021, that allowed stakeholders a final opportunity to provide feedback before the Board considered adopting the proposed revisions to Rule 1.4, to correct language in the rule that conflicts with portions of the statute (section 12-265-113 (3), C.R.S.); and revisions to Rules 1.6. 1.8, 1.9, and 1.11, to fix typographical errors. These revisions were identified and required by the Office of Legislative Legal Services (OLLS)

The Colorado Board of Examiners of Nursing Home Administrators held a Permanent Rulemaking Hearing on September 15, 2021, that allowed stakeholders a final opportunity to provide feedback before the Board considered adopting revisions to Rule 1.1(B), to implement Colorado Senate Bill 21-077 (Concerning the elimination of verification of an individual's lawful presence in the United States as a requirement for individual credentialing).

Permanent Rulemaking Hearing - May 26, 2021
The Colorado Board of Examiners of Nursing Home Administrators held a Permanent Rulemaking Hearing on May 26, 2021, that allowed stakeholders a final opportunity to provide feedback before the Board considered adopting multiple revisions to the rules as required by the rule review mandated by section 24-4-103.3, C.R.S. The purpose of the rule review was to assess the continuing need, appropriateness, and cost-effectiveness of the rules to determine if they should be continued in their current form, modified, or repealed.
