New 2019 Legislation

On May 16, 2019, Governor Jared Polis signed SB19-234 Sunset Professional Review Committees. The new law, which will be effective August 2, 2019, continues the registration and reporting requirements of professional review committees under the Colorado Medical Board and the State Board of Nursing, which are both in the Division of Professions and Occupations (DPO) in the Department of Regulatory Agencies (DORA), until September 1, 2030. The law:

  • Adds and updates various definitions (e.g., original source documents and records).
  • Repeals requirement for recommendations following a hearing to be promptly forwarded to the Medical Board or Nursing Board, if the subject of the investigation is licensed by either.
  • Clarifies the reporting of governing board data to DPO.
  • Specifies when original source documents are protected or subject to subpoena, discovery, or use in civil action.
  • Requires governing boards to annually update their information with DPO.
  • Requires DPO to promulgate rules regarding the information a governing board is required to report and establishes a process to remove governing boards from the registry.
  • Encourages a professional review committee regulated by the Department of Public Health &, Environment to appoint a consumer as a non-voting member
