Colorado Medical Board - Requesting Written Stakeholder Comments

The Colorado State Medical Board is requesting written comments regarding proposed revisions to Rule 1.31 - CONCERNING HEALTH CARE PROVIDER DISCLOSURES TO CONSUMERS ABOUT THE POTENTIAL EFFECTS OF RECEIVING EMERGENCY OR NONEMERGENCY SERVICES FROM AN OUT-OF-NETWORK PROVIDER and APPENDIX C – YOUR RIGHTS AND PROTECTIONS AGAINST SURPRISE MEDICAL BILLS. The purpose of the proposed rules is to establish requirements for health-care providers to disclose to covered persons who are utilizing a health benefit plan about the potential of “balance billing” when receiving 1) post-stabilization services or 2) covered non-emergency services from an out-of-network provider at an in-network facility. The Colorado Medical Board is considering proposed changes to Rule 1.5 - RULES AND REGULATIONS RELATING TO THE UNITED STATES MEDICAL LICENSING EXAMINATION, THE COMPREHENSIVE OSTEOPATHIC MEDICAL LICENSING EXAMINATION-USA, AND THE FEDERAL LICENSURE EXAMINATION. The purpose is to update the exemptions requirements. Additionally, the Board is considering proposed changes to Rule 1.28 – USE OF BENZODIAZEPINES. The purpose is to conform the existing rule to the requirements of sections 12-30-109(6) and 12-280-404(4)(a.5), C.R.S. Please submit written comments as soon as possible, in order for your comments to be considered before the public rulemaking hearing scheduled for Thursday, November 20, 2025, at 11:00 A.M. Written comments will be posted on the website under the "Public Notices" tab as received for all stakeholders to access and review.


Colorado Medical Board – Stakeholder Meeting – September 29, 2025

The Colorado Medical Board is requesting feedback regarding proposed new Rule 1.33 – RULES AND REGULATIONS REGARDING CONTINUING MEDICAL EDUCATION FOR PHYSICIANS. The purpose is to implement Colorado House Bill 24-1153 (CONCERNING CONTINUING EDUCATION REQUIREMENTS FOR PHYSICIANS).


Colorado Medical Board – Stakeholder Meeting – September 22, 2025

The Colorado Medical Board is requesting feedback regarding proposed revisions to Rule 1.9 – DEMONSTRATION OF CONTINUED COMPETENCY BY PHYSICIAN ASSISTANT APPLICANTS FOR LICENSURE, LICENSURE PURSUANT TO THE OCCUPATIONAL CREDENTIAL PORTABILITY PROGRAM, REINSTATEMENT OF AN EXPIRED LICENSE, OR REACTIVATION OF A LICENSE and Rule 1.15 – RULES AND REGULATIONS REGARDING THE LICENSURE OF AND PRACTICE BY PHYSICIAN ASSISTANTS. The purpose is to implement Colorado Senate Bill 23-083 (CONCERNING AN EXPANSION OF A PHYSICIAN ASSISTANT'S ABILITY TO PRACTICE, AND, IN CONNECTION THEREWITH, CHANGING THE RELATIONSHIP BETWEEN A PHYSICIAN ASSISTANT AND A PHYSICIAN OR PODIATRIST FROM SUPERVISION TO COLLABORATION).

Continuing Education Requirements

HB24-1153: Physician Continuing Education became law on August 6, 2024. Documented continuing education will be required beginning with the 2027 renewal cycle. 

The next step in the implementation process for this law is rulemaking. You may sign up for rulemaking notifications here. A rule clarifies statute. It has the effect of law. When it comes to physicians, rules are promulgated, or made, by the Colorado Medical Board (Board).

Every rule has a stakeholder process governed by the Administrative Procedures Act (Section 24-4-101, Colorado Revised Statutes). Stakeholder engagement can take multiple forms. Some of these may include accepting written comments, having stakeholder meetings, having public comment during rulemaking hearings and more.

Legislative Updates

The Division of Professions and Occupations regulates more than 450,000 licensees, certificate holders and registrants. Ex-Offenders Practice in Regulated Occupations

On June 4, 2024, Governor Polis signed HB24-1004 Ex-Offenders Practice in Regulated Occupations into law. Under this bill, if an applicant for a registration, certification, or license has a conviction for a crime, a regulator may only consider the applicant’s conviction for a three-year period beginning on the date of conviction or the end of incarceration, if the applicant has not been convicted of any other criminal offense during the three-year period. Address Confidentiality Program (ACP)

The Address Confidentiality Program (ACP) is a statewide program administered by the Department of Personnel and Administration (DPA) that provides survivors of domestic violence, sexual offenses, and/or stalking with a legal substitute address for interacting with all state and local government agencies. Rules and Regulations Regarding a Physicians Role in Prescriptive Authority

Physician preceptors and mentors must comply with the full rules on Prescriptive Authority adopted by the Colorado Medical Board. Failure to comply may constitute grounds for disciplinary action.

Summary

  • APN's who wish to obtain Prescriptive Authority are required to:
    • Have national certification.
    • Hold a graduate or post-graduate nursing degree.
    • Complete an 750-hour mentorship. 

Requirements for the 750-hour Mentorship and Physician Mentor

  • Completed within 3 years of Provisional Prescriptive Authority (RXN-P) being granted.
  • Documented in writing and signed by the mentor(s) and RXN-P.
    • Outlines a process and frequency for ongoing interaction and discussion of prescriptive practice throughout the mentorship.
    • The document will be retained for three years after the completion of the mentorship by the APN (RXN-P) and the physician mentor.
  • The mentor shall not require payment or employment as a condition of entering into the mentor relationship.
  • In recognition of the mentor's time and expertise, reasonable fair market expenses may be paid. Compensation will be mutually agreed upon and shall not be onerous or represent a barrier to completion of the mentorship.
  • At the conclusion of the mentorship, the physician will sign an Attestation that the mentorship was completed.
